The Crime

In the early morning hours of February 9th, 1991, the victim awoke to find a man standing in the bedroom of her apartment. He raped her with a knife and vaginally. He then left.

The landlord was identified by the victim when she called for help. pillowcases and semen-stained sheets were among the evidence collected by the police. Ms. Lindow told police that her attacker had a raspy voice and had a mustache.

The investigation is ongoing.

The landlord was not included in any of the identification procedures. Two days after the attack, a photo array was conducted. The victim didn’t identify anyone, but she did find someone in a live lineup who she thought was her attacker. The man who reminded her of her attacker was not included in the third photo array. She didn’t make a positive identification, but she found similarities between the two. In a fourth identification procedure two months after the attack, she saw five men who she had not seen before. Although the victim stated that she was undecided between Frey and another person, she ultimately chose Frey, but also stated that she could not positively identify the person who attacked her.

He was implicated in two sexual assaults in Green Bay. He maintained his innocence even though he pled guilty to the crimes. He was convicted of these crimes before his trial for the University of Wisconsin-Oshkosh student rape.

Police collected evidence from the crime scene, but with the exception of semen-stained bed sheets, it was destroyed before the trial. The evidence was labeled as hold for investigation or evidence and the detective who destroyed it didn’t recall receiving an order to do so. There is no record of what evidence was originally collected because police reports, inventory reports, chain of custody reports, etc. were destroyed. RFLP testing on semen-stained bed sheets excluded Frey as the source of the semen in 1991. The boyfriend was excluded as a contributor.

The Trial

The semen must have been left behind by the roommate’s boyfriend because the state explained the absence of biological evidence. The roommate said she had sex with her boyfriend on the victim’s bed. The State presented testimony from a jailhouse snitch who said that Frey had admitted to raping two women in Green Bay. On February 2, 1994, a jury found Frey guilty.

Post-Conviction.

The semen-stained bed sheets were recently discovered, despite Frey’s belief that all the physical evidence had been destroyed. The victim’s DNA was commingled with James E. Crawford’s. Crawford was never a suspect in the original investigation, but he did match the description of the attacker.

Crawford was sentenced to 30 years in prison for sexually abusing two young sisters after the attack on the University of Wisconsin-Oshkosh student. Crawford’s mother reported that he tried to confess to a rape before he died due to multiplesclerosis and heart problems.

While the State decided whether or not to re-try Frey, he remained in jail after the judge overturned his conviction. The charges were dropped and the man was released on July 12, 2013, after prosecutors decided not to try him again. If he had been released on the other sexual assault convictions in 2005, he would have served eight years for a crime he didn’t commit.
